Who we are and what these terms cover

Nishani Health is operated by Nishani Health, Inc., a Delaware corporation. Nishani Health is a care-management platform for adults living with treatment-resistant depression, bipolar disorder, or schizophrenia.

These terms cover two things: the Nishani website, which describes the product, and the Nishani check-in service, which a care organization can use with the people it cares for.

About this website

This site describes the product. It is not an available clinical service.

Content here is provided as is, without warranties of any kind. Nothing on this site is an offer of services, a solicitation, or a commitment to provide anything.

The site's content belongs to Nishani Health. You may read it, quote it, and link to it.

The check-in service

The check-in service is software. A care organization uses it with the people in its care, and Nishani Health operates the software.

Clinical decisions, treatment, and the medical record stay with the care organization. We do not deliver treatment and we do not make clinical decisions about anyone.

Messages

The program is Nishani Health check-in texts. Messages come from Nishani Health and carry a link to a short check-in from your care team.

You receive them only after you tell a member of your care team that you agree to them. Agreeing is optional and is not a condition of your care.

Messages arrive about once a week, or daily while a response of concern is open.

Reply STOP to any message to stop them; you receive one message confirming it. Reply HELP for contact details, or write to wilsonyeh@nishanihealth.com.

Message and data rates may apply. Carriers are not liable for delayed or undelivered messages, and we cannot guarantee that a message arrives, or when.

Emergencies

The service is not monitored continuously and is not an emergency service.

A check-in that raises a concern becomes a task for your care team to pick up during their working hours. It is not an emergency response, and it does not replace your care team's emergency process.

Your care

The care organization that enrolled you is responsible for your care.

Nishani Health provides software. Questions about your treatment, your symptoms, or your record belong to that organization.

Acceptable use

Do not use the service for anything unlawful.

Do not attempt to access the service, its data, or another organization's records without authorization.

Do not reverse engineer, resell, or attempt to extract the software.

Do not use the service to send bulk or automated messages.

Availability and changes

We may change the service — the check-in questions, the frequency of messages, and what a care team sees.

We may pause or discontinue the service. We tell your care organization first.

The service is provided as is and on an as-available basis. We do not warrant that it will be uninterrupted.

Intellectual property

This site and the software belong to Nishani Health and its founders.

We grant no licence to the software other than the right to use it on the terms your organization agreed with us.

Disclaimers and limitation of liability

The service and this site are provided as is. To the extent the law allows, we disclaim all warranties, express or implied, including any warranty of fitness for a particular purpose.

To the extent the law allows, we are not liable for indirect or consequential loss arising from the service or this site.

We are not liable for clinical outcomes, and using the service does not create a clinician–patient relationship.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Ending the arrangement

Your care organization can end its use of the service at any time.

You can stop receiving messages at any time by replying STOP.

When the arrangement ends, what happens to your information is handled under your care organization's agreement with us.

Governing law

These terms are governed by the laws of the State of California, and the state and federal courts located in Los Angeles County have jurisdiction.

Changes to these terms, and how to reach us

We may update these terms. When we make a change that affects your rights, the date at the top of this page changes with it.
